The “Dadah Winery” website and the services provided by it (the “Website”) are operated by the winery.
It is clarified that the site is intended for the purpose of providing ongoing services to customers.
The use of the website is subject to the terms of the ordering policy as detailed below (the “Ordering Policy”) as well as the Website’s terms of use and the site’s privacy policy (“Site Regulations”).
A user who does not agree with the website regulations and/or the Ordering Policy, all or part of them, is not be allowed to use the website and/or in the services included in, or provided by it for any purpose. The winery may change the Ordering Policy and/or the Site Regulations at any time and according to its sole discretion and this change will be binding from that time (as updated and uploaded to the Website) and thereafter.
The current version of the Ordering Policy, as published on the website, will be the binding version even if on time the user joining, the site had a different version in effect.
Use of the website is permitted only for users who are over 18 years old.
The sale on the Website is for consumer customers only.
The winery reserves the right to change the content of the Website, including the services included in (or provided by) it, stop, remove or add to them, at any time, all or some of them.
Additionally, the winery may change the terms and conditions of the Ordering Policy from time to time, add to or remove from them, as related to activity on the Website or its use – in whole, in part, specific feature or application thereof, at any time, at its sole discretion and without advance notice.
The user, at all times, bears full responsibility for knowing the terms and conditions of the Site Regulations, and use of the website (and related services), according to these terms and conditions of the Website regulations.
The use of the masculine and singular is for convenience only and also addresses the feminine/plural/other user(s).
The winery is entitled to stop the ordering activity on the Website, in whole or in part, for a certain period or in an unlimited manner, at its full discretion and without prior notice.

Use of the site
The site allows the user to place orders for the winery’s products.
Upon entering the Website for the first time, the user may select the desired wines/products, add them to the shopping cart and fill in the required details.
The user will make sure that the provided residential address is within the distribution areas of the company, since the orders delivery is only possible in the distribution areas of the winery.
In addition to the prices of the products, the user will be charged shipping fees as determined by the winery from time to time, for the delivery of the products chosen/purchased, and as they will appear on the order form during the order placement, unless specifically stated otherwise on the Website by the winery.
Each time an order is placed, the user will be asked to confirm by clicking on a checkbox (“Checkbox”) that they read and agree to the terms of use of the Website as well as to the terms of this policy.
For the avoidance of doubt, it is clarified that it is solely the user’s responsibility to prevent and not allow access to any unauthorized persons.
The winery will not be liable for any damage due to the disclosure of means of entry to the user’s account due to the user’s negligence and/or due to execution of an order by an unauthorized party on the user’s side and/or making an order by a third party.
The user must check and verify the contents of the shipment upon receipt and compare it to the order placed on the website.
The winery must be contacted by phone (on business hours) at (+972) 04-6262112 within one business day of delivery of the order, in case the products received do not match the products ordered on the website, or in the event that there is another problem with the products provided.
For the avoidance of doubt, it will not be possible to return invalid products after they have been received.
Charging will be done by phone, before the shipment leaves for the customer.
Orders and delivery dates
Placing orders: the user can place an order for wines/products through the Website, which will be delivered according to the delivery dates to be arranged and agreed by phone with the user.
The user can order any wine/product that is in stock.
As long as the order is not completed, the user can change quantities, add or remove products from the shopping cart.
It is possible that orders by users may involve minimum quantities which will change from time to time and from order to order at the winery’s discretion.
Delivery dates: Orders placed by the user, will be delivered up to ten (10) business days from the order placement date (“Delivery Date”).
The user agrees that in cases of unusual or special work-loads, the delivery may be delayed.
In such a case, the winery will not be liable for any direct or indirect damage which may be caused by such a delay.
The user/customer will have no claim and/or right to damages be they direct or indirect, and/or claim to cancel the order.
Changes to orders or cancellation of delivery date: Changing the order specification or canceling the delivery date can be done up to 48 hours from the time of placing the order, by sending an email to dadahwinery@gmail.com by referencing the order number only (no other form of order identification will be acceptable).
The user agrees that such a change in the order will be made by canceling the original order and making a revised order, by and under the user’s responsibility and that this may result in a change to the delivery date according with the time of the change in the order.
Canceling an order: The user may cancel orders for products ordered via the website insofar as the user has the right to cancel in accordance with, and subject to the provisions of the law, and in particular the provisions of the Consumer Protection Law, 1981 through a notice to be delivered to the company within one business day of the order date.
The notice can be given in writing by email to dadahwinery@gmail.com. In the cancellation notice, the user must state the user’s name and order number.
In case of cancellation of an order, the user must return products in their original packaging, without use, and without defect.
In the event of a cancellation due to unsuitability or defect, the winery will refund the user by the full amount paid for the order, within seven (7) days from the date of receipt of the cancellation notice, provided that the wine/product is returned in its original packaging and has not been used in any way.
In the event of a cancellation that is not due to unsuitability or defect, the winery will refund you the amount you paid for the wine minus shipping fees, using the payment method used for the order, within seven (7) days from the date of receipt of the cancellation notice, provided that the wine/product is returned in its original packaging and has not been used in any way.
Placing an order, order summary and payment terms: At the end of the order process, an order summary page will be presented with details of the items ordered by the user, including price details, shipping fees, VAT, deposit, as far as relevant, delivery date, etc.
The user will be charged according to the amount that will appear in the summary, which will be sent to the user after the transaction is completed or that will be sent to the user’s home along with the order details. When placing the order, the user will confirm that they are 18 years of age or older and that they agree that due to the working hours of the winery, the order may be delivered without the customer’s presence and that the products may be left outside the door at the delivery address as provided in the order, as long as the user has confirmed it in a message to dadahwinery@gmail.com.
It is clarified that, in any case, the winery and/or anyone on its behalf is not responsible and will not bear any damage and/or expense and/or loss, direct or indirect, caused to the user and/or someone on his behalf due to a change, cancellation or postponement of the delivery of an order on behalf of the winery and/or someone on its behalf.
The products on the Website
The winery may at any time and at its sole discretion, add and/or remove and/or change the variety of the products offered for sale on the Website, without notifying the user, and that the user waives in advance all claim and/or demand in connection therewith.
For each product offered for sale on the Website, a picture may be shown for illustration purposes only and a non-exhaustive description of specifications of the product including its price in new Israeli shekels (“shekels”) according to its legal rate and year of harvest.
The user is aware that, subject to the provisions of any law, the winery may offer different products and/or promotions and/or certain conditions to all users or to some of them, and they waive any claim in connection with the aforementioned.
In the event of a disagreement or difference between a product image and its description, the written description will prevail.
Regardless, it is hereby clarified that the written description is not necessarily exact and/or complete, and is intended as a general, non-exhaustive, informative explanation of the product’s characteristics.
It is hereby clarified that the sale and supply of intoxicating beverages to people under the age of 18 is prohibited. The winery may require a presentation of a valid ID, to ascertain that the purchaser is not a minor, prior to the supply of intoxicating beverages.
In the event of a claim being filed by the user, the procedure will be determined in the relevant court in Hadera (ISRAEL) only.
